The Site is operated by pamdishes, a culinary content provider, and these Terms constitute a legally binding agreement between you (“User”, “you”, or “your”) and pamdishes (“we”, “us”, or “our”).
Subject to compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to:
Any other use—including but not limited to reproduction, distribution, public performance, or creation of derivative works—requires our prior written consent. Unauthorized use may result in termination of your access and may expose you to civil and criminal liability.
All original content posted on pamdishes, including recipes, photographs, videos, articles, and design elements (collectively, the “Content”), is owned by pamdishes or its licensors. Except as expressly provided in Section 2, you may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or sell any Content without our explicit written permission.
User‑generated content that you submit to the Site (e.g., comments, reviews, photos) is licensed to us under a worldwide, royalty‑free, irrevocable, non‑exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media now known or later developed. You represent and warrant that you own all rights to the submitted material and that such material does not infringe any third‑party rights.
The Site and all Content are provided on an “as‑is” and “as‑available” basis, without any warranties of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, non‑infringement, or accuracy. We do not guarantee that the Site will be uninterrupted, error‑free, or free of viruses or other harmful components.
All culinary instructions, nutritional information, and ingredient lists are provided for general informational purposes only. We are not a medical, dietary, or health professional, and the Content should not be used as a substitute for professional advice. Users assume full responsibility for any health, safety, or legal consequences arising from the preparation, consumption, or handling of any recipes or food items described on the Site.
We expressly disavow any liability for third‑party content, advertisements, or links that may appear on the Site. The inclusion of any external link does not constitute endorsement or guarantee of the linked site’s accuracy, completeness, or legality.
To the maximum extent permitted by applicable law, pamdishes, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising under these Terms shall not exceed the amount you have actually paid to pamdishes, if any, in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so the above limitations may not apply to you in full.
Negotiation. In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Site, the parties shall first attempt to resolve the matter informally through good‑faith negotiations. Either party may initiate negotiations by sending a written notice to the other party’s contact address listed below.
Arbitration. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in English in New York, New York, United States, unless the parties agree otherwise in writing.
The arbitrator shall have the authority to award any relief that a court of competent jurisdiction could grant, including injunctive relief and damages, and shall issue a written award that is final and binding. Judgment on the award may be entered in any court having jurisdiction.
Governing Law. These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict‑of‑law principles.
Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
We reserve the right to modify, amend, or replace any part of these Terms at any time, in our sole discretion. When we make material changes, we will post a revised version on the Site with an updated “Last Updated” date and may provide additional notice (e.g., via email or a banner on the Site). Your continued use of the Site after such changes constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to the Site, in whole or in part, at any time and for any reason, including without limitation for violations of these Terms, illegal activity, or any conduct that we deem harmful to the Site or its users. Upon termination, all licenses granted to you under these Terms shall immediately cease, and you must destroy any downloaded or printed copies of Content.
